With the results of a new survey of 500 small business managers clearly showing that mediation is often not seen as a viable option by SMEs, Acas has urged businesses to reappraise their view of this underused process.
The survey revealed that only 7% of businesses had used mediation and that 52% believed that mediation was only suitable for large organisations. However, the survey also demonstrated that businesses recognised the potential value of mediation, with 72% indicating that mediation could be a good tool for resolving workplace disputes, and 63% saying that a wider use of mediation could reduce employment tribunal claims.
Of those who had used mediation, 82% said that it had resolved the issue either completely or partially. So, while many small businesses seem reluctant to use mediation services, the overwhelming majority of those who do feel that they have benefitted as a result.
Ironically, although many small businesses feel that mediation is not a suitable option for them, the lack of dedicated HR departments in smaller organisations can mean that small disputes quickly escalate into something more serious and potentially damaging for the employer.
Mediation allows for a far greater flexibility of dispute resolution than is available through the legal system, offering options that can resolve matters to the satisfaction of both parties without incurring the high costs of litigation.
